1 Definitions & Interpretation
- “Website” means the PickyTic platform accessible at pickytic.ai and any associated subdomains or applications.
- “Content” encompasses all website materials including test papers, solutions, images, documents and digital works.
- “User” describes any person accessing the Website β Students, Parents, Teachers, Contributors and Guests.
- “Minor” means any student user under 18 years of age.
- “Community Use” means sharing Content non-commercially within groups such as student cohorts or tuition classes.
- “Commercial Purposes” means any use of platform Content in exchange for monetary or non-monetary remuneration, including but not limited to using Content in paid tuition sessions, reselling or redistributing Content, incorporating Content into commercial teaching materials, or using Content to develop competing products or services.
- “Rights Holder” denotes the intellectual property owner of Content.
- “Community Curator” (CC) refers to individuals creating and uploading original educational materials to the platform while retaining ownership and granting distribution rights as described in Section 5.
- “Token” means a unit of platform credit that powers AI features including grading, feedback and the AI Study Buddy chat. Tokens are non-monetary and have no cash value.
- “Subscription” means a recurring paid plan that provides a monthly Token allocation in exchange for a periodic fee.
2 Governing Law & Jurisdiction
- These Terms are governed by and construed in accordance with the laws of Singapore.
- You irrevocably submit to the exclusive jurisdiction of the courts of Singapore to settle any dispute or claim arising out of or in connection with these Terms or your use of the platform.
- Nothing in this clause limits PickyTic’s right to seek urgent injunctive or other equitable relief in any jurisdiction.
3 Account Creation, Parental Consent & Minor Users
- Parent or Guardian Account Required: All student accounts must be created and managed by a parent or guardian. Students (whether under or over 13) may not register independently. By creating an account, the parent or guardian confirms they are aged 18 or above and legally authorised to accept these Terms on behalf of their child.
- Under-13 Enhanced Protection: For students under 13, parental consent is mandatory before any data is collected and stricter privacy defaults apply in accordance with PDPC advisory guidelines for children’s data.
- Minors Aged 13β17: These students remain Minors under Singapore law. Parents and guardians are responsible for supervising their child’s use of the platform and for all activity on accounts linked to their parent account.
- Explicit Consent: By registering your child, you explicitly consent to the collection and use of their personal data for educational and assessment purposes as described in our Privacy Policy.
- Data Rights: Parents may access, correct or delete their child’s data via the account dashboard at any time.
- Account Accuracy: You must provide accurate and current information during registration and keep it updated. You are responsible for maintaining the confidentiality of your account credentials.
4 Data Collection, Use & Privacy
- What We Collect: Necessary information including name, grade, gender, assessment results and usage data for personalisation.
- Security: Data is encrypted in transit and at rest with strict access controls.
- Accuracy & Retention: Data undergoes regular accuracy review and is securely deleted in accordance with the retention periods set out in our Privacy Policy.
- Compliance: Student, parent and educator data is handled in accordance with Singapore’s PDPA and PDPC guidelines, with enhanced protections for children.
- Privacy Defaults: Privacy-protective settings are enabled by default for all student accounts.
- Full Privacy Policy: Your complete data rights and our full data practices are set out in our Privacy Policy, which forms part of this agreement.
5 Intellectual Property
- Content Ownership: Content remains the exclusive property of the respective Rights Holder.
- User Uploads: Ownership of user-uploaded Content stays with the uploader unless otherwise stated.
- Student Licence: Students receive a limited, non-exclusive, non-transferable, revocable licence for personal educational use only. This licence does not permit commercial use, redistribution or reproduction.
- Community Curators: By uploading Content as a Community Curator, you grant PickyTic a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, distribute, display, modify and redistribute your Content for educational purposes on the platform and through authorised channels. You retain original ownership of all uploaded Content. This licence survives termination of your account to the extent necessary to continue providing existing access to students who have accessed the Content.
- MOE-Aligned Content: Content aligned with the MOE curriculum is used with proper licensing or permissions.
- PickyTic Platform: All platform software, design, branding and non-user-generated content is owned by or licensed to PickyTic and may not be copied, modified or used without written permission.
6 AI-Generated Content & Recommendations
- AI Functions: AI manages grading, feedback and learning suggestions on the platform. AI outputs are educational tools, not official assessments.
- No Guarantee: AI outputs serve educational purposes and are not guaranteed to be error-free. Results should not be used as the sole basis for important academic decisions.
- Human Review: Users may request a human review or appeal of AI-generated results by contacting support@pickytic.ai within 14 days of receiving the result.
- Fairness: AI grading undergoes continuous testing for fairness and bias mitigation across student groups.
- Clarity: Feedback is presented in clear, understandable language accessible to students and parents.
7 Gamification & Child-Safe Experience
- Design Principles: Gamification is optional, educational and child-safe throughout the platform.
- Prohibited Patterns: The following are strictly prohibited: infinite streak pressure, fear-based nudges, pay-to-win mechanics, shaming, or public ranking of children without parental consent.
- Leaderboards: Leaderboards default to private or require parental opt-in approval before activation.
- Parental Controls: Parents can control gamification settings, usage limits and reward resets.
- Personal Data: Gamification data (XP, coins, streaks) constitutes personal data and is handled under PDPA protocols.
- No Advertising: The platform prohibits child-targeted advertising and manipulative design practices of any kind.
8 Prohibited Activities
- Commercial Use: Using platform Content for Commercial Purposes (as defined in Section 1) requires prior written consent from PickyTic. Requests may be submitted to support@pickytic.ai.
- Redistribution: Redistribution of complete test papers, solutions or questions outside of personal use requires explicit permission from the Rights Holder.
- Infringing Uploads: Uploading third-party content that infringes intellectual property rights is strictly prohibited and may result in immediate account suspension.
- Copyright Alteration: Removing or altering any copyright notices associated with Content is a violation of these Terms.
- Account Misuse: Sharing account credentials, creating multiple accounts to circumvent token limits, or using automated tools to access the platform is prohibited.
9 Subscriptions, Tokens & Payment
- Free Tokens: New accounts receive a starter Token allocation (currently 500 tokens, valid for 90 days). This is a one-time allocation. PickyTic reserves the right to change the free allocation at any time with notice.
- Subscription Plans: Paid Subscription plans are billed on a recurring monthly basis. By subscribing, you authorise PickyTic to charge your payment method at the applicable rate at the start of each billing cycle.
- Token Refresh: Subscription Tokens refresh at the start of each billing cycle. Unused Tokens do not roll over to the next cycle and have no monetary value.
- Non-Transferability: Tokens and Subscriptions are personal to the account holder’s family (parent account and linked child profiles). They may not be transferred, sold or assigned to any other account or person outside the linked family unit.
- No Refunds: All Token purchases and Subscription fees are non-refundable once charged, except where required by applicable Singapore consumer protection law. Cancelling a Subscription prevents future charges but does not entitle you to a refund for the current billing period. Any remaining Token balance at cancellation is forfeited.
- Cancellation: You may cancel your Subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period.
- Price Changes: PickyTic may change Subscription prices by giving at least 30 days’ written notice by email. Continued use of a paid plan after the effective date constitutes acceptance of the new price.
- Payment Security: All payments are processed by Stripe. PickyTic does not store your card details.
10 Liability & Disclaimer
- “As Is” Basis: Content and platform features are provided “as is” without warranties of accuracy, completeness or fitness for any particular purpose. PickyTic does not warrant that the platform will be uninterrupted, error-free or free from viruses.
- Liability Cap: To the maximum extent permitted by law, PickyTic’s total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the platform shall not exceed the total fees paid by you to PickyTic in the 12 months immediately preceding the event giving rise to the claim, or S$100, whichever is greater.
- Exclusion of Consequential Loss: PickyTic is not liable for any indirect, incidental, special or consequential loss or damage, including loss of data, loss of revenue, loss of profits or academic outcome, whether arising in contract, tort or otherwise, even if PickyTic has been advised of the possibility of such loss.
- AI & Gamification: AI and gamification outputs are learning indicators only and do not constitute guarantees of academic performance, examination results or school admission outcomes.
- Consumer Rights: Nothing in this Section limits any rights you may have under the Consumer Protection (Fair Trading) Act (CPFTA) or any other applicable Singapore law that cannot be excluded by contract.
11 Termination
- By PickyTic: PickyTic reserves the right to suspend or terminate your access to the Website immediately upon breach of these Terms, uploading of prohibited content, or conduct that is harmful to other users or the platform.
- By You: You may close your account at any time by contacting support@pickytic.ai. Closing your account cancels any active Subscription and forfeits any remaining Token balance.
- Effect of Termination: Upon termination, your licence to use the platform ceases immediately. Sections 2, 5, 10, 12 and 13 survive termination.
12 Dispute Resolution
- Informal Resolution First: Before commencing any formal proceedings, you agree to contact PickyTic at support@pickytic.ai and attempt to resolve the dispute informally. PickyTic will respond within 14 working days.
- Mediation: If the dispute is not resolved informally within 30 days, either party may refer it to mediation before the Singapore Mediation Centre (SMC) in accordance with its mediation rules in force at the time.
- Litigation: If mediation does not resolve the dispute within 60 days of the referral, either party may commence proceedings in the courts of Singapore in accordance with Section 2.
- Small Claims: Nothing in this section prevents either party from bringing a claim in the Singapore Small Claims Tribunal where the claim falls within its jurisdiction.
13 General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and PickyTic and supersede all prior representations, agreements or understandings.
- Document Hierarchy: In the event of conflict between these Terms, the Privacy Policy and the Disclaimer, these Terms shall prevail.
- Notices: Formal notices to PickyTic must be delivered by email to support@pickytic.ai. Notices to you will be sent to the email address registered to your account.
- Severability: If any clause is found to be invalid or unenforceable, it shall be severed from these Terms without affecting the validity of the remaining provisions.
- No Waiver: Failure by PickyTic to enforce any provision of these Terms at any time does not constitute a waiver of that provision.
- Force Majeure: PickyTic is not liable for any failure or delay in performance arising from events beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government orders or restrictions, war, cyberattacks, internet or infrastructure outages, power failures, industrial disputes or failure of third-party service providers.
- Assignment: PickyTic may assign its rights and obligations under these Terms to a successor entity in connection with a merger, acquisition or sale of assets, provided that the successor entity assumes all obligations under these Terms. You may not assign your account or rights under these Terms without PickyTic’s written consent.
14 Updates to Terms of Use
- Non-Material Changes: PickyTic may make minor updates (e.g., clarifications, typographic corrections) at any time. The “Last Updated” date at the top of this page will be revised.
- Material Changes: Changes that materially affect your rights or obligations β including changes to fees, liability, data use or intellectual property β will be communicated to registered users by email at least 14 days before taking effect. If you do not accept a material change, you may close your account before the effective date. Continued use of the platform after the effective date of a material change constitutes acceptance.
- Version History: Users may request a copy of previous versions of these Terms by contacting support@pickytic.ai.
15. Contact & Complaints
For inquiries, takedown notices or feedback regarding these Terms of Use, please contact us. We aim to acknowledge all formal complaints within 3 working days and resolve them within 30 days.
